Appeal decided positively

The Plenipotentiary receives requests from citizens to address the situation of disconnection from public utilities. Public utilities do not always comply with the requirements of the legislation on the procedure and conditions for the suspension and restriction of the provision of public services.

 

For example, the Commissioner received an appeal from a citizen of F., a resident of Kazan, about his disagreement with the power outage in his apartment due to arrears of payment.

 

Please note that, in accordance with paragraph 117 of the Rules for the Provision of Public Utilities to Owners and Users of Premises in Apartment Buildings and Residential Buildings, approved by the Decree of the Government of the Russian Federation on 06.05.2011,354 The public utility service provider shall limit or suspend the provision of public services by notifying the consumer in advance in case of partial payment by the consumer of the public service.

In this case, partial payment by the consumer of the utility service means the existence of a debt of 1 utility service in an amount exceeding the amount of 2 monthly fees for the utility service, calculated on the basis of the standard consumption of utilities and the tariff for the corresponding type of utilities.

 

During the consideration of the appeal, we drew attention to the fact that the amount of the author’s debt for the «electricity supply» service does not exceed two months of the utility fee. Given the above, we sent a letter to the State Housing Inspectorate of the Republic of Tatarstan, on the basis of which our arguments were confirmed.

 

The supervisory authority of the managing organization has drawn up a report on the administrative offence, as well as an order for the elimination of violations and the resumption of the supply of public services. Currently, the electricity supply in the author’s apartment has been restored.
