I received an appeal from citizen B., who disagreed with the decision to refuse to initiate criminal proceedings regarding the injury sustained by his young son, born in 2022.
According to the applicant, the child sustained a serious leg injury while in the playroom of the family-run oriental restaurant "P.Love." The injuries were so severe that they required specialized medical intervention in the form of surgery.
After filing a criminal complaint with the internal affairs authorities, the applicant was repeatedly redirected, and subsequently, the Investigative Department for the Sovietsky District of Kazan issued a ruling refusing to initiate criminal proceedings due to the absence of a criminal offense. Disagreeing with these findings, Mr. B. contacted me for protection of his rights.
To protect the rights of the applicant and his child, I contacted the Prosecutor General of the Republic of Tatarstan with a request to review the applicant's arguments and, if warranted, take prosecutorial action.
Following an investigation by the Sovetsky District Prosecutor's Office of Kazan, the applicant's allegations of a serious injury to his young son in the restaurant's playroom were confirmed. As a result, the previous decision was reviewed, and the investigative department opened a criminal case under paragraphs "b" and "c" of Part 2 of Article 238 of the Criminal Code of the Russian Federation: providing services that do not meet life or health safety requirements for consumers intended for children under six years of age, resulting in the negligent infliction of serious bodily harm.
