In the report on the activities of the Commissioner for 2023, the issues of violation of citizens' rights when limiting or suspending the provision of public utilities were highlighted. Despite the measures taken, the Ombudsman continues to receive appeals on this subject.
The Commissioner received an appeal from citizen F., a resident of Kazan, about the disconnection of electricity in the residential premises in violation of the requirements of current legislation. In this case, the applicant reported that she had repeatedly addressed this issue to the management organization and the competent state authorities, but no measures were taken to eliminate violations.
In the course of consideration of the appeal it was pointed out that the notification (warning) on suspension of the provision of public utilities was sent in violation of the current legislation, namely without specifying the debt for a particular utility service to be disconnected.
As a result of consideration of the Commissioner's request, the State Housing Inspectorate of the Republic of Tatarstan sent a warning to the managing organization about inadmissibility of violations of mandatory requirements in terms of compliance with the procedure for suspension of public utilities. In the course of a telephone conversation the applicant informed about the resumption of provision of public utilities.
The analysis of citizens' appeals shows the need to strengthen control over the observance of consumer rights in the sphere of housing and communal services.
