The appeal was resolved positively
The pension system plays an important role in ensuring a decent life for citizens in Russia and is one of the important components of social security.
The issues of observance and protection of human and citizen's rights, freedoms and legitimate interests in the field of pension (social) security are in the zone of increased attention of the Commissioner.
The Commissioner received an appeal from citizen G., who lives in Leninogorsk, about disagreement with the amount of early retirement insurance pension accrued to her in connection with her teaching activity.
To clarify all the circumstances of the case on this appeal, I sent a request to the manager of the Department of the Pension and Social Insurance Fund of the Russian Federation in the Republic of Tatarstan to provide me with information and documents necessary for consideration of the appeal and further decision-making on it.
As a result of consideration of the submitted documents by the Department of the Pension and Social Insurance Fund of the Russian Federation in the Republic of Tatarstan at our request was revealed an error in determining the amount of early old-age insurance pension to the applicant, consisting in the fact that the recalculation of the pension by the body carrying out pension provision was incorrectly taken into account the applicant's salary.
I note that in accordance with part 4 of Article 28 of Federal Law No. 400-FZ, in case of discovery of an error made by the body responsible for pension provision in the establishment and (or) payment of labor pensions, state pension provision pensions and other monetary payments, the establishment of which is entrusted to these bodies, these bodies shall eliminate this error based on the norms of the legislation of the Russian Federation, including bringing the amount of these pensions and other monetary payments in accordance with the legislation of the Republic of Tatarstan.
At present, the error made by the body responsible for pension provision has been eliminated, and the applicant's underpayment has been transferred by the Department of the Pension and Social Insurance Fund of the Russian Federation in the Republic of Tatarstan to the applicant's settlement account.
