Orphans and children left without parental care and persons from among them need special assistance from the state because of their vulnerability. Provision of housing is one of the measures of social support for this category of citizens.
I received an appeal from citizen A., a resident of the city of Kazan, who disagreed with the decision of the Ministry of Education and Science of the Republic of Tatarstan to refuse to include him in the list of orphans and children without parental care and persons from their number to be provided with housing (hereinafter referred to as the list). The reason for the refusal was the absence of documents confirming the impossibility of living in the previously occupied housing.
It was evident from the text of the application that the applicant was not the owner of any residential premises, as well as a tenant (family member) of a tenant of residential premises under a social rent agreement.
As a result of consideration of the information provided by the Ministry of Education and Science of the Republic of Tatarstan at our request, it was found that the requirement of documents confirming the applicant's inability to live in the previously occupied residential premises was unnecessary.
In connection with the identification of violations of the applicant's housing rights, I sent recommendations to the Commissioner on the need to eliminate these violations.
Following consideration of our recommendations by the Ministry of Education and Science of the Republic of Tatarstan, the decision to refuse inclusion in the list was canceled and a new decision was made to include the applicant in the list.
