One of the most vulnerable categories of the population is children who have lost their parents. The State provides housing in the absence of orphans and children deprived of parental care and persons belonging to them. In our work, great attention is paid to the protection of the housing rights of orphans and children without parental care.
I was approached by the legal representative of the orphan child about disagreement with the decision of the Ministry of Education and Science of the Republic of Tatarstan on refusal to include the ward in the list of orphans and children left without parental care, and the persons to be provided with accommodation (hereinafter referred to as the list).
From the text of the appeal, it was understood that the orphan child was not the owner of any living quarters, nor the tenant (family member) of the tenant under a social contract.
Based on the results of the examination of the documents submitted by the Ministry of Education and Science of the Republic of Tatarstan at our request, the arguments of the applicant were confirmed. In connection with the identification of violations of the housing rights of orphans, I sent recommendations to the authorized body on the need to eliminate these violations.
Following consideration of our recommendations by the Ministry of Education and Science of the Republic of Tatarstan, the decision to refuse inclusion in the list was annulled, and a new decision on inclusion of an orphan child in the list was made with the date of inclusion from the first appeal to the authorized body.
