Caring for the disabled is a very hard job, requiring a lot of effort and resources, time and patience. The law establishes certain guarantees for workers with a disabled child.
Thus, labour legislation provides for a number of benefits for employees with disabled children in a family, one of which is additional paid holidays.
Article 262 of the Labour Code of the Russian Federation stipulates that one of the parents (a guardian or guardian) is entitled, on written application, to four (four) additional paid days off per month; which may be used by one of the designated persons or divided between them at their discretion. Each additional day off is paid for in the amount of average earnings and in the manner prescribed by federal laws. The procedure for granting these additional paid rest days is established by the Government of the Russian Federation.
On 6 May 2023, the Government of the Russian Federation approved new rules for the provision of additional paid holidays for the care of disabled children, which will enter into force on 1 September 2023.
The Rules stipulate, inter alia, that from 1 September 2023, a parent (guardian, guardian) of a disabled child will be able to accumulate additional days off during a calendar year and take up to 24 additional days off in succession to care for a disabled childdisabled. This will require the employer to submit a written application within the agreed time frame.
The decision also provides for the possibility of granting one of the parents of a disabled child additional rest days left unused by the other parent.
